This agreement is between you and Filbunke AB and governs your use of SimplicityPDFeditor (the "App"), including the free tier, the trial and the Pro purchase. By installing or using the App you accept this agreement. If you do not accept it, do not install or use the App.
Plain-language summary (not a substitute for the terms below): the App is licensed, not sold; buying Pro is a one-time purchase of the App as it exists on the day you buy it; we do not promise that the App will work on future operating systems or that we will develop it forever; your documents are your responsibility to back up; and nothing in this agreement takes away rights that the law of your country guarantees you as a consumer.
We grant you a personal, non-exclusive, non-transferable licence to install and use the App on Windows devices as permitted by the Microsoft Store rules under which you acquired it. The App is licensed, not sold. We retain all rights not expressly granted.
You may not, except to the extent applicable law permits notwithstanding this limitation: copy, modify, distribute, sell, rent, lease or sublicense the App; reverse engineer, decompile or disassemble it; remove or alter any notices in it; or use it to develop a competing product by systematic reproduction of its behaviour.
The App embeds open-source components — PDF.js (Mozilla, Apache License 2.0) and pdf-lib (MIT License) — which remain governed by their own licences. Nothing in this agreement restricts rights those licences grant you.
Opening, viewing, annotating, highlighting and printing PDF files are free for as long as we make the App available, at no charge.
Features that change a document (including merging, splitting, extracting, inserting images, watermarks, page numbers, page organising and flattening — together "Pro features") may be used free of charge for a 7-day trial that begins the first time you use a Pro feature. When the trial ends, Pro features require the one-time Pro purchase, made through the Microsoft Store.
The Pro purchase unlocks the App as it exists on the day of purchase. The trial exists precisely so that you can make the purchase decision with the complete product in your hands. New features or versions, if any, may be offered separately and are not part of what you purchase. Payment, receipts and any refunds are handled by Microsoft under the Microsoft Store terms.
The App is compatible with the Windows versions stated in its Microsoft Store listing at the time you acquire it. That statement is our entire compatibility commitment.
We do not warrant that the App will function, or continue to function, on any operating system version, hardware, or configuration released or modified after the date of your purchase. Operating system vendors change their platforms in ways outside our control, and such changes may degrade or end the App's functioning. A failure of the App caused by a change to the operating system or other environment after your purchase is not a defect in the App. We may, at our sole discretion, release updates addressing such changes, but we are under no obligation to do so.
We have no obligation to provide updates, upgrades, new features or maintenance, except for any updates that mandatory law requires us to provide to keep the App in conformity for a reasonable period after your purchase (for consumers in the EU, see section 9). Updates we do release may be delivered through the Microsoft Store and may modify or remove functionality, provided the App retains materially the functionality you purchased.
Support is provided on a reasonable-efforts basis via support@filbunke.eu. We do not guarantee response times or resolutions. We may limit, change or end support for old versions, and we may discontinue the App entirely; if we discontinue Pro sales while the App remains installed, functionality you have already purchased continues to work on the environment it worked on at the time, subject to section 3.
The App edits documents you choose to open, on your device, at your direction. You are responsible for keeping backup copies of important documents before editing them. Features that permanently alter content — such as flattening, or operations that make annotations permanent — are identified in the App and act only on your instruction. To the maximum extent permitted by law, we are not liable for loss of or damage to documents or data.
The App processes documents locally on your device, makes no network requests while running, and collects no personal data. The full privacy policy is at https://pdf.filbunke.eu/privacy.html and forms part of this agreement.
To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, quiet enjoyment, and any warranties arising from course of dealing or usage. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App will meet your requirements.
To the maximum extent permitted by applicable law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill, data or documents, however caused and under any theory of liability, even if advised of the possibility; and (b) our total aggregate liability arising out of or relating to the App or this agreement is limited to the amount you actually paid for the App in the twelve months before the claim arose, or, if you paid nothing, to zero.
Nothing in this agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or for fraud.
If you are a consumer, the laws of your country of residence may give you rights this agreement cannot change — including, in the European Union, rights under Directive (EU) 2019/770 concerning the conformity of digital content and the supply of updates necessary to maintain conformity for a period you are reasonably entitled to expect, and in Sweden under konsumentköplagen (2022:260). Nothing in this agreement excludes, limits or affects those statutory rights. Sections 3, 4, 7 and 8 apply only to the extent permitted by such laws.
For clarity: statutory conformity is assessed against the product and environment at the time of supply. Those rights do not oblige us to make the App compatible with operating systems released after your purchase.
This agreement is effective until terminated. It terminates automatically if you breach it. On termination you must stop using and uninstall the App. Sections 5, 7, 8, 9 and 11 survive termination.
This agreement is governed by the laws of Sweden. If you are a consumer, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remainder remains in effect. This agreement is the entire agreement concerning the App and supersedes prior communications about it. This agreement is concluded in English; translations, where provided, are for convenience only and the English text prevails. We may update this agreement for new versions of the App; the version that applies to you is the one in force when you acquired the App or the update in question. Microsoft is not a party to this agreement and has no obligations under it, except as stated in the Microsoft Store terms.
